Trademark Litigation

Polo/Lauren v USPA

A famous example of our success in fighting for our clients’ trade mark protection in Singapore was in the case of Polo/Lauren Co. LP v United States Polo Association. At the Intellectual Property Office of Singapore (IPOS), Ralph Lauren claimed that their iconic polo rider on horseback, ubiquitously depicted on shirts across the world, had been infringed by the logo of our client USPA due to its similarity – and that USPA’s mark had been registered in bad faith. Both of these claims having been rejected by IPOS, Ralph Lauren appealed to the High Court of Singapore on the first claim – that the marks’ similarity would be likely to cause confusion to the consumer. The High Court accepted our arguments and dismissed Ralph Lauren’s appeal awarding costs to our client.

Opposition to Trademark Applications

We assist clients in opposing trademark applications that they felt threatened their brand's exposure.

We have represented major consumer goods manufacturers, social media giants and world-renowned fashion houses in successfully removing applications for marks that would have been confusingly similar to their own, and thus protecting their intellectual property rights.

Likewise, we have prevailed in many cases where our client's trademarks were opposed. One such example was in defending the United States Polo Association's logo against Polo Ralph Lauren before the Registry in Singapore.

Non-Use Revocations

Depending on the jurisdiction, after a certain amount of years of apparent 'non-use', parties can put forward non-use revocation actions to the Registry, in order that these marks may be revoked and deemed no longer protected.

We have successfully revoked marks for clients who have felt that an unused mark was compromising their intellectual property enforcement capabilities.

Company Name Complaints

We assist clients in respect of conflicts and complaints in respect of company names before national company registries.
